The agency must clearly demonstrate the use and necessity of the requested information. 4) The agency needs to identify the medical and/or physical requirements of any position that the claimant may be offered. 5) Follow the rules for non-employment medical problems. 5) Maintain all medical information in a separate and highly confidential folder. In summary the agency cannot just go about gathering medical information. Every type of request is strictly regulated.
